Whistle — Terms and Conditions of Sale


This document constitutes the terms and conditions of use of the Whistle Associates ("Whistle") website and services. It is also necessary to read our Privacy Policy in which we explain how we handle personal data. You will find a brief explanation of the Terms and Conditions in the boxes. This is not a legal contract.

Acceptance of the Terms

You must read, understand and accept these Terms and Conditions ("T&Cs") before entering www.whistle.associates or clicking on any of its links ("the Site"). By entering the Site, you agree to be bound by these T&Cs, which, together with our Privacy Policy, govern our relationship with you. You may not enter until you have read and accepted the Terms of Service ("TOS"). You agree that Whistle may use the data you share on www.whistle.associates in accordance with our Privacy Policy, which is attached.

Access to the Site

From time to time, the Site may be inaccessible or your browsing may be interrupted due to equipment failure, upgrades, maintenance or any other reason beyond Whistle's control. Whistle reserves the right to suspend or discontinue the Site or Services, and to remove any content at its sole discretion without notice. Whistle also reserves the right to establish limits on certain features and services or restrict access to certain areas or to the Site and its Services generally, without notice or liability.

Limitations of Liability

Whistle acts as the publisher of the Site. Whistle is responsible for the quality and accuracy of the Content it publishes.
Whistle cannot be held responsible for direct and indirect damage caused to the user's equipment when accessing the Whistle website, and resulting either from the use of equipment that does not meet the specifications indicated in point 4, or from the appearance of a bug or an incompatibility. Whistle cannot be held responsible for indirect damages (such as loss of market or loss of opportunity) resulting from the use of the Whistle website. Interactive spaces (possibility to ask questions in the contact area) are available to users. Whistle reserves the right to delete, without prior notice, any content posted in this area that contravenes the legislation applicable in France, in particular the provisions relating to data protection. If necessary, Whistle also reserves the possibility of calling into question the civil and/or penal responsibility of the user, in particular in the case of messages of a racist, insulting, defamatory or pornographic nature, whatever the medium used (text, photographs, etc.).

Offer and details

Whistle offers a 3-day online challenge.
Caribbean Design Days: Bruk'It Edition is a 3-day online hackathon format for Caribbean entrepreneurs, project leaders or those "curious about entrepreneurship" who wish to discover a business approach based on design methods with entrepreneurs from other islands. Each format takes a specific theme. They are held in English.

They will be able to live test their business creativity alongside other Caribbean entrepreneurs, around one main topic. They will get insights and masterclasses from Design, Marketing and Strategy experts. Overall, they will get to prototype and test their ideas !

Actual price: 750$ (647,10€) , Special introductory price for the Alé Vini Guadeloupe Homecoming Coaching operation: 450$ (388,26€).

The challenge is an ensemble of general courses and exercises or "off the shelf", done remotely via digital media. The details of the courses are presented on the website and may be subject to change without prior notice.

Rules for Students

By booking a place in the Whistle challenge, you agree to all the terms and conditions, including the cancellation policy published on the Site.
All Courses offered on Whistle will be available only during the established period.
You agree to follow all reasonable rules established by the teacher for the Course and not to do anything that would interfere with the work of the teacher or other students in the Course.
You agree to attend the Course for educational purposes only and in no way intend to copy material or techniques for your own benefit or for use in other courses, or to interrupt a Course or interfere with the teacher's relationship with his or her students.

Once payment for the Course has been made, you will be able to download the associated material indefinitely. The material will remain available for download to your email indefinitely from the date of payment.

Except as expressly authorized in writing and signed by an authorized representative of Whistle, you agree not to reproduce, redistribute, transmit, allocate, sell, retransmit, rent, lease, share, loan, modify, adapt, edit or create derivative works from, sublease, transfer or use the Courses.

Payment and Fees

Whistle offers a flat fee, and payment facilities.  Whistle does not refund the booking. Whistle collects payments via Stripe. The price of Courses or any other Services may change without notice.


Both the Site and third parties may provide links to other websites. Because Whistle is not responsible for the content of other websites, you acknowledge and agree that we cannot be held responsible for the availability of other websites or for the content, advertising, products or other materials available on their pages. You acknowledge and agree that Whistle shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with your content, goods or services available on or through any such site.We are not responsible for links posted by users.

Whistle Intellectual Property

The trademarks, logos, code samples, computer programs and other content of Whistle (Whistle Content) included in the Services are protected by intellectual property rights. Access to the Site does not grant you any rights to such content. You may not use the Content on our Site unless authorized by the owner or permitted by law. You may not use any of the Whistle trademarks or logos included in our Services without our consent. You may not remove, obscure, or alter the text or notices included in Whistle Content. You may not create databases from Whistle Content.

Limitation of Liability Clause

In no event shall Whistle or its suppliers or licensors, be liable with respect to any matter arising under these Terms under contract, negligence, strict liability or any other legal or equitable theory for: (i) any special, incidental, or consequential damages; (ii) the cost of procurement or substitute products or services; (iii) for interruption of use or loss or corruption of data; or (iv) for any amount that exceeds the fees paid by you to Whistle under these Terms during the twelve (12) month period preceding the cause of action. Whistle shall have no liability for any failure or delay due to matters beyond their reasonable control. The foregoing shall not apply to the extent that it is prohibited by applicable law.


Whistle reserves the right, at its sole discretion, to modify or replace any part of these T&Cs. It is your responsibility to periodically check these Terms and Conditions for changes. Your continued use of the Site following the posting of any changes to these TOS constitutes acceptance of those changes. In addition, Whistle may decide to offer new services and features in the future. If so, such services and features will be subject to this Terms of Use ("TOU").
